Terms of use

Who this is between

These terms are between you and JURMR, the individual who writes and publishes FullVolume ("I", "me"). They cover the game FullVolume, the charting tool FullVolumeCharter, the website fullvolumethegame.xyz and anything else published under the FullVolume name, together called "the software" below.

By downloading, installing or using any of it, you accept these terms. If you do not accept them, do not install it, and uninstall it if you already have.

You must be old enough to agree to a contract where you live. If you are not, an adult responsible for you has to agree on your behalf.

What you get

You get a personal, worldwide, royalty-free, non-exclusive licence to install and use the software for as long as these terms are kept. You do not get ownership of it. FullVolume is closed source: the copyright in the program, its artwork, its sounds and its name stays with me.

The licence costs nothing and always has. There is no paid tier, no unlock, no subscription and no account. If you paid somebody for a copy of FullVolume, you were sold something that is given away here for free, and you should ask them for your money back.

What you may do

• Install it on as many machines as you want, at home, at work, at a party, in a venue.
• Hand the unmodified installer to anybody. Copy it to a USB stick, send it to a friend, put it on the shared drive at work. Linking to this site is nicer, because they then get updates, but passing the file along is fine.
• Play it in public, and charge people to be there. Karaoke nights, streams, videos, events. You do not owe me anything for that, and you do not need permission. Whether you have the right to play the music in public is a separate question and section 5 is about that.
• Stream it and put it on video. Monetise the video if you can. A credit or a link is appreciated and not required.
• Make charts with FullVolumeCharter and do what you like with them, subject to section 6.

What you may not do

• Sell it, rent it, or put it behind a paywall, a survey, a link shortener that pays you, or an advert gate. It is free, and it has to reach people free.
• Repackage or rebrand it. Do not bundle it inside another installer, wrap it in an adware installer, ship it with anything else, or put your own name on it.
• Pass it off as yours, or claim you wrote it.
• Modify, decompile, disassemble or reverse engineer it, except exactly as far as the law where you live says you may regardless of what this document claims.
• Strip out, forge or work around the version check, the update check, or any notice about who made it.
• Use it to attack anything. That includes hammering the online rooms, the update endpoint, this website, or the catalogues the Marketplace links to.
• Use it where it is illegal to.

The music is yours to sort out

FullVolume ships with no music whatsoever. No songs, no charts, no lyrics, no recordings. It reads files that are already on your computer, put there by you.

That means the legal position of those files is entirely yours. You are responsible for having the right to hold them, to play them, and to play them in front of whoever you are playing them in front of. Public performance of recorded music is licensed separately in most countries, and running a karaoke night in a venue usually needs one of those licences. Nothing here gives you one, and nothing here can.

I do not host, supply, index or scan your music, and I have no way of knowing what is in your library. If you do not have the right to a file, do not put it in a folder the game is watching.

Charts you make

A chart you make in FullVolumeCharter is yours. I claim no ownership of it and no licence over it, and the tool sends nothing anywhere.

Be aware of what a .fvchart file actually contains: the song's audio is packed inside it, along with the album art and any backdrop you added. Sharing one is therefore sharing the recording, with all the same rules that would apply to sending somebody the audio file on its own. That is your call and your responsibility.

If you publish charts somewhere, do not imply they are official or endorsed. They are yours.

The Marketplace

The Marketplace on this website is a search over two public community catalogues of rhythm game charts. It is a directory and nothing more.

• No chart is hosted here. Downloads come from the catalogue that holds them.
• Nothing is sold, and no money changes hands anywhere in it.
• I did not make those charts, I cannot vouch for them, and I cannot fix them.
• Those sites have their own terms and their own privacy policies, and using them means accepting theirs as well as these.

If something listed there should not be, say so and it will come off the list.

Online rooms

The online rooms are provided as a convenience and as they are. There is no uptime promise, no guarantee a room will still be there tomorrow, and no support contract.

When you are in a room with other people:

• Do not harass, threaten, abuse or hound anybody.
• Do not use slurs, or pick on somebody for who they are.
• Do not broadcast anything sexual involving children, or anything illegal, over voice or chat. Ever.
• Do not deliberately ruin a room: no blasting noise down the microphone, no spamming chat, no impersonating other people.
• Do not attempt to break, flood, exploit or take over a server.

Rooms are not moderated in real time, because there is one of me. If you are in a room that has gone bad, leave it and make a private one with a code. Persistent or serious abuse of the public rooms can and will get an address blocked, without notice and without appeal.

Anything you say over voice or chat is heard by everybody in the room, and I have no way of knowing what was said or getting it back for you.

Names, chat and backdrops

Singer names, room names, chat messages and custom backdrops are yours and stay yours. You keep every right in them and I claim none.

You are responsible for what you put in them. Do not use a name or a backdrop that is somebody else's to use, that is illegal where you are, or that is chosen to harass somebody. A room name is visible to anybody browsing the public list, so treat it as public, because it is.

Tips

There is a tip jar. It goes to Ko-fi, who handle the payment and hold the payment details; I never see a card number and neither does the game.

A tip is a gift. It buys you nothing: no feature, no priority, no support, no say in what gets built, and no version of the game that anybody else does not also have. It is not refundable by me, and any refund is between you and Ko-fi under their terms. Please do not tip money you need.

Beta software, and no warranty

FullVolume is beta software. It has bugs. It will keep having bugs. Things move between versions, and something that worked last month may work differently this month.

The software is provided "as is" and "as available", with no warranty of any kind, express or implied. To the fullest extent the law allows, that includes any implied warranty of merchantability, fitness for a particular purpose, non-infringement, accuracy, or that it will run uninterrupted or error-free.

Your data is your job. Profiles, scores and charts live in Documents\Full Volume and are not backed up anywhere by me. Keep copies of anything you would mind losing, particularly charts you have spent an evening on.

Some countries do not allow certain warranties to be excluded. Where that is the case, those rights are yours and nothing here takes them away.

Liability

To the fullest extent the law allows, I am not liable for any indirect, incidental, special or consequential loss arising out of the software: lost data, lost charts, lost recordings, lost time, lost profit, a ruined party, or damage to hardware.

Where liability cannot lawfully be excluded, it is limited to the greater of ten pounds sterling or whatever you actually paid me for the software, which for effectively everybody is nothing.

Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.

Changes to the game

Features get added, changed and occasionally taken out again. The online rooms may be changed or switched off entirely at any time. None of that is promised to you, and none of it entitles you to anything.

The game checks GitHub for a newer release when it starts, and offers you the installer if there is one. You can turn that check off under Settings, General. It never installs anything without you saying yes.

Ending it

You can end this at any time by uninstalling the software. There is nothing to cancel and nobody to tell.

Your licence ends automatically if you break these terms, particularly sections 3 and 4. If that happens, stop using the software and remove it. I may also block an address from the online rooms as described in section 8, which does not otherwise affect your right to keep playing on your own.

Sections 5, 11, 12, 15 and 17 carry on applying after this ends.

Other people's names

FullVolume is an independent project. It is not affiliated with, endorsed by or connected to Clone Hero, YARG, Harmonix, Microsoft, Sony, Ubisoft, or anybody who makes or made any other music game.

Names like Clone Hero, YARG, Rock Band, SingStar, LIPS, Xbox and Windows belong to their owners, and are used on this site only to say plainly what FullVolume reads and what it is like, which is what trade mark law calls nominative use. No claim over any of them is made or implied.

Changes to these terms

These terms may change. When they do, the date at the top of this page changes with them, and the new version applies from the day it is published. Carrying on using the software after a change means you accept it.

If a change is substantial rather than tidying, it will be called out in the release notes for the version it lands with.

If any part of these terms turns out to be unenforceable, the rest of it still stands.

Law and contact

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer somewhere else, this does not take away the protections of your own country's law that cannot be contracted out of.
